Liberty University Agrees to Pay $14 Million For Concealing, Under reporting Sexual Abuse

Liberty University has agreed to a $14 Million fine for under reporting and concealing sexual assaults, according to an announcement by the U.S. Department of Education announced Tuesday. The unprecedented fine is the largest ever levied under the federal Clery Act. 

Liberty, which benefited from $874M in student loans, was accused of failing to report crimes committed on campus, discouraging victims from reporting the crimes, failing to properly warn about threats, destroying evidence, failing to keep proper records, and ultimately not treating it as seriously as the law (and scripture) requires. In one damning example of Liberty University’s failures, we read:

The Department is aware of multiple cases that demonstrate the negative effects that these policy,
procedural, and programmatic deficiencies had on the University’s approach to incidents of sexual
violence and the victims who reported them.

As one example, the review team calls attention to LUPD Incident #19-02750.20 In this case, a victim reported that she was raped. The victim stated that in furtherance of the attack, the perpetrator slapped her, pulled her hair, and threatened her by reminding her that he carried a knife. The perpetrator also engaged in coercive, intimidating, and manipulative behaviors. Despite these reported facts, the investigator unfounded this case based on a claim that the “victim indicates that she consented to the sexual act.”

In point of fact, the victim’s own statement merely indicated that she “gave in” in an attempt to get away from the perpetrator. To state the obvious, “consent” acquired by threat or force is no consent at all. To make matters worse, it is now clear that the initial report was mishandled by an LUPD officer, and in that process, the investigator, and the LUPD at large, failed to gather more information about two other incidents of sexual assault reported by the victim.

Responding to the agreement, Liberty University complained in their own press release that “Many of the Department’s methodologies, findings, and calculations in the report were drastically different from their historic treatment of other universities” and that “Liberty disagrees with this unfair treatment.”

Nevertheless, the university was able to negotiate a final settlement, less than half of the $37.4 million dollars they were initially facing, writing “While the university maintains that we have repeatedly endured selective and unfair treatment by the Department, the university also concurs there were numerous deficiencies that existed in the past. We acknowledge and regret these past failures and have taken these necessary improvements seriously.”

Liberty University Faces $37.4M Fine for Concealing Sexual Abuse

Liberty University continues to face more legal and reputational woes, with a leaked report showing the U.S. Department of Education (ED) is considering levying a $37.4M fine for a Clery Acts Violation.

The Clery Act “requires colleges and universities that receive federal funding to disseminate a public annual security report (ASR) to employees and students every October 1st. This ASR must include statistics of campus crime for the preceding 3 calendar years, plus details about efforts taken to improve campus safety.

ASRs must also include policy statements regarding (but not limited to) crime reporting, campus facility security and access, law enforcement authority, incidence of alcohol and drug use, and the prevention of/response to sexual assault, domestic or dating violence, and stalking.”

Liberty which benefited from $874M in student loans, is accused of under reporting crimes committed on campus, discouraging victims from reporting the crimes, destroying evidence, failing to keep proper records, and ultimately not treating it as seriously as the law (and scripture) requires.

University President Dondi E. Costin rebuffed much of the information in the report, saying in a statement:

“The most damaging element of this whole process is the fact that for the first time that any of us are aware, the Department of Education leaked a preliminary report while we are in the process of negotiating with the department about all the advancements that we’ve made. And so that’s the biggest issue.

They are making claims about our intentions. They’re claiming that we acted in bad faith. I think there are a number of factual errors in the report. For instance, they are assuming that individuals who are making these claims are accurate and honest and transparent without exception, when in fact, much of the assertions that they’ve made are based on purely anecdotal information.”

Liberty is also facing a $35M lawsuit from former President Jerry Falwell Jr over  for the unauthorized use of his late father’s image in a building dedicated to him.

Liberty University Reaches Settlement Over Claims it Hid Rapes, Punished Victims

After being in the headlines for the better part of two years over claims that they were covering up sexual assault and dismissing and punishing the victims, Liberty University, home of disgraced former president Jerry Falwell Jr, reached a settlement with 20 of the 22 women who accused them of wrongdoing.

Jerry Larkin, the lawyer for the Jane Does who filed a class-action lawsuit alleging that the University was violating federal anti-discrimination law Title IX by failing to process and investigate credible claims of sexual assault and harassment allegations properly, acknowledged that “the case is now settled” but not disclose what the terms were, noting that it was never about the money for the plaintiffs, but rather about the exposure that would spur Liberty on to action.

“While there are large provisions that the plaintiffs will continue to be able to talk about, there is no non-disclosure agreement that would prevent them from telling their stories in the future, but the terms of the settlement itself and the conduct of the mediation are both confidential” 

In a statement put out by Liberty, they say they’re committed to doing what they can to “make things right” and reveal several of the strategies and initiatives they put in place even before the settlement was reached, including:

“over $8.5 Million in security upgrades, including the installation of security cameras, blue lightboxes, and enhanced campus lighting, along with the launching of a cell phone app for emergency reporting”

Crucially, rather than just throwing money at the problem, the university also launched reviews of its policies and procedures as it relates to Title IX , such as :

“Additional mandatory training for students and employees. There will also be changes to Liberty’s amnesty policy. The existing policy is now being revised to better communicate — with respect to reports of sexual harassment and/or assault— that Liberty does not discipline parties who engage in behaviors, in connection with that sexual harassment and/or assault, that would have otherwise violated its student honor code.”

There is no word yet on the next course of action for the two Jane Does who did not settle.

Liberty University Being Investigated by U.S. Department of Education for Mishandling Sexual Assault

A year after 12 women filed a class-action lawsuit against Liberty University, home of disgraced former president Jerry Falwell Jr, alleging that the University was violating federal anti-discrimination law Title IX by failing to process and investigate credible claims of sexual assault and harassment allegations properly, another woman has come forward and filed a lawsuit on account of their mishandling of her case.

In her filing, ‘Jane Doe’ alleges that” Liberty failed to investigate the rape and assault, refused reasonable accommodations for the Plaintiff, was deliberately indifferent to Plaintiff’s sexual assault and injuries, retaliated against the Plaintiff, and perpetuated a hostile and dangerous environment on and around campus, culminating in Plaintiff’s suspension from the university.”

In response to the news that they were being investigated by the US Department of Education, the University said in a statement:

“Liberty University welcomes the U.S. Department of Education’s review of our Clery Act compliance program…We have pledged our full cooperation and look forward to the opportunity to strengthen and enhance our program through this assessment process. We have also committed to work collaboratively with the Department to address any potential compliance gaps identified through the review. Liberty supports and embraces both the letter and the spirit” of the Clery Act.

Liberty University Professor Arrested, Charged with Kidnapping and Sexual Battery

Police have arrested a professor with Liberty University for sexual battery and kidnapping charges following an incident involving a student back in September, according to online court records.

William Atwell, 58, who has been at Liberty University since 2013, was arrested by campus police on November 20th and was released two days ago on a $3000 bond.

He has officially been charged with felony abduction by force/intimidation and misdemeanor sexual battery. According to a statement made by a Liberty university spokesperson made to WFXR News:

“Liberty University takes nothing more seriously than claims that a faculty member has had inappropriate sexual contact with one of our students, something for which there is zero tolerance. We are treating this matter with the utmost seriousness, care, and concern. With the student’s consent, the university turned the matter over to the appropriate legal authorities and the faculty member in question was arrested. The faculty member has also been suspended by the university pending the outcome of this matter. To protect the integrity of investigation and the privacy of the student, we will limit further comment.”

Atwell is scheduled to appear in court on Jan. 25, 2022.

Liberty University Files Restraining Order to Keep Fired Whistleblower Quiet

Liberty University has filed a restraining order against a former employee to prevent him from disclosing any more confidential information and documents that he’s been sharing with the public, an act the employee said he had permission to do.

Scott Lamb, the school’s former Senior Vice President of Communications, was terminated earlier this year. He says it’s because he expressed concerns over the way Liberty was handling sex abuse cases and the fact that they were covering them up and not taking them seriously. The school says he was given the ax for poor performance, insubordination and mismanaging his expenses, and that his concerns about handling sexual abuse had nothing to do with it.

Furthermore, they say Lamb signed a confidentiality agreement in 2018, one which he has shown a willful disregard for.

The motion is demanding that Lamb give up ‘all documents or other information, including all privileged, confidential, and/or trade secret information” and to disclose everyone he’s sent this information to. A memorandum added to the suit explains:

“Although many of these materials were likely protected trade secrets, privileged communications or attorney work product protected information, Lamb has admitted that he disclosed them to the media, general public and commercial enemies of Liberty without privilege or prior permission as contractually required.

Perhaps most shockingly, Lamb has demonstrated no regard for the attorney-client privilege, freely discussing privileged advice regarding litigation strategy and other matters on national media.”

Lamb, for his part, has remained defiant. While he has not addressed discussing the privileged advice and litigation strategy, he says that he had permission to share the information he alleges got him fired. Chiefly, he says that when the firm Baker Tilly interviewed him in 2021 about the whole Jerry Falwell Jr. affair, he gave over 20 hours of testimony, explaining in a response on Twitter:

“Before my first minute of testimony, I was given a 2-page letter of ‘whistleblower protection,’ signed by interim president Jerry Prevo, instructing me to speak honestly, forthrightly, thoroughly, and without any regard to the reputation of the school, its leadership, or its board. And Prevo promised that there would be no retaliation for my honest testimony…

“I indicted the former president, the Board of Trustees for negligence and Jerry Prevo as the chairman of the trustees during the entire presidency of Jerry Falwell Jr. Baker Tilly presented their report to Jerry Prevo and the Board of Trustees on September 29. Seven days later, Jerry Prevo fired me.”

Veggie Tales Creator Fact-Checked by Co-host for Saying Dumb Stuff About the Bible

Veggie Tales creator Phil Vischer, the man who swears he’s not progressive despite knocking creationists as a bunch of dummiescrediting his white privilege for the success of his show, arguing that liberals and Democrats are the real pro-lifers who have been reducing abortion, and recently claiming he didn’t know there was such things black Christians until he was an adult, was given a brief dose of clarity after mugging for his audience in order to dunk on the largest Christian University and conservatives in general.

During the February 24 edition of the Holy Post Podcast, Vischer was engaging in all sorts of scornful quippery when co-host Skye Jethani swiftly shot down his suggestion that “Liberty University” is an idolatrous name, and evidence of “Christian Nationalism.”


–TRANSCRIPT– KAITLYN SCHIESS: When I was at Liberty [University], I worked in social media, and so I kept up with all of our social media channels, including Pinterest. And one day I noticed that Liberty’s account had pinned this picture of a Bible, it looked like a Bible verse, but then someone with crayons or colored pencils had colored an American flag on top of the verse. And I was like rolling my eyes and I was gonna unpin it because I didn’t, like, before I knew what Christian nationalism was, wasn’t real thrilled with it. But then I read the verse and I thought, like, “It does sound like it’s about America. It doesn’t sound like it’s Israel.” And then I realized it’s because this was not a Bible verse. It was from the Book of Mormon. But we didn’t really care, because it sounded really pro-America. And we liked that, so we pinned it.

PHIL VISCHER: Wow. Here, I have another one. I have another one to add to our own list [of “you might be a Christian nationalist if…” jokes]. If you name your Christian college a word that appears in the Declaration of Independence but not in the Bible, you might be a Christian nationalist.

SKYE JETHANI: I’m pretty sure “liberty” occurs in the Bible.

VISCHER: Yeah, I was trying to think of some [laughs]. I could have been talking about Thomas Jefferson, who signed it. His name is on there. Thomas Jefferson College of the Bible. Everyone gets a pen knife on the first day of school.

Video: Liberty University Prez Apologizes for ‘Super-Spreader’ Snowball Fight

Liberty University Jerry Prevo has apologized after photos were posted online of a mega-snowball fight between hundreds of university students, few if any of who were wearing masks and all were violating the school’s COVID-19 Protocols for social distancing.

Prevo made the remarks in a press release on the school’s website, explaining that he done goofed by getting caught up in the moment of seeing freshly fallen snow.

He says he went outside and “immediately engaged in some snowball fights with a few students;” an act that snowballed from there as more joined the fray.

I messed up. We did not think through or communicate the need to wear facial coverings and remain 6 feet apart in compliance with Virginia Governor’s Executive Orders for the suppression of the spread of COVID-19 or even our own COVID-19 Operations Plan. And the size of the group was not in compliance either.

We made a mistake in not enforcing the guidelines that we have followed routinely and sincerely for these many months. We have had a strong record of compliance and containment of COVID-19 from the start, and we want our community to know that Sunday’s snowball event was not done with a heart of defiance. The mistake was one of being caught up in the moment of the day. I and my leadership team apologize for not leading our students to abide by COVID-19 protocols during this event.

The university took down pictures of the event out of concern that failing to do so would “undermine a culture of compliance,” but we have found one for your viewing pleasure.

Liberty University Students Call for Shutdown of Falkirk Center for ‘Tarnishing’ Christian Witness

(Christian Post) A group of students and alumni at Liberty University are calling for a think tank at the evangelical Christian college focused on political activism to be shut down.

More than 400 students have signed a petition calling on the Lynchburg, Virginia-based university to shut down the Falkirk Center for Faith and Liberty, a think tank founded last year by then-Liberty President Jerry Falwell Jr. and Turning Point USA founder Charlie Kirk. The petition, titled “Liberty United Against Falkirk,” contends that the think tank has “waged war against decency, respect, and Christian charity, all while misrepresenting Liberty students and the Christian church.”

The stated purposes of the Falkirk Center are to “uphold the Christian faith and defend America’s Constitution” and to “inform all Americans in matters of faith and liberty, and then deploy these faithful men and women across every medium and platform to protect and defend our strongest-held beliefs in every facet of society.” The think tank also stresses the importance of “bold, unapologetic encouragement and initiative on the part of every conservative American.”

The petition took issue with the Falkirk Center’s assertion that “although we do, as Jesus taught, turn the other cheek in our personal relationships…

Liberty University Pulls John Piper Video after Trump Criticism

(Ministry Watch) Liberty University removed videos of evangelical author and speaker John Piper from its website after the well-known pastor wrote a blog post that was seen as critical of President Donald Trump.

According to Christianity Today, Piper and Southern Baptist Convention President J.D. Greear recorded a video conversation with David Nasser, Liberty’s senior vice president for spiritual development, in mid-October. The two resulting videos were posted online about a week later. 

The conversation was timed to coincide with the 20th anniversary of Piper’s best-known book, “Don’t Waste Your Life.” Greear has a new book out on a similar topic, called “What Are You Going to Do With Your Life?”
